AODA Retrofit Guide: Grandfathering, Triggers & What Compliance Actually Requires

Older buildings aren't automatically required to meet today's accessibility standards — until a specific trigger event ends that grandfathered status. Here's what ends it, and what a retrofit involves once it does.

A lot of Ontario businesses assume that because their building has always operated the way it does, it's exempt from today's accessibility requirements. That assumption has a name — grandfathering — and it's true, up to a point. The trouble is that grandfathered status isn't permanent, and most property owners don't find out it's ended until a renovation, an inspection, or a complaint forces the question.

This guide covers what grandfathering actually means, exactly what ends it, and what an accessibility retrofit involves once it does.

What "grandfathering" means for an existing building

When a building was constructed or last renovated to code, it met the accessibility standards in effect at that time. As Ontario's accessibility requirements have been strengthened since — through the AODA's Design of Public Spaces Standard (O. Reg. 191/11) and successive updates to the Ontario Building Code — older buildings haven't automatically had to retrofit just because the code moved on. That's the grandfathering principle: existing conditions are generally not required to be upgraded to the current standard purely because the standard changed.

What grandfathering does not mean is that the building is permanently exempt, or that the owner can ignore the Human Rights Code's separate duty to accommodate. It also doesn't mean the property is exempt from AODA's non-physical requirements — customer service policies, staff training, and communication accessibility apply regardless of when the building was constructed.

What ends grandfathered status

Grandfathering ends when a specific triggering event occurs. At that point, the affected part of the building — and in some cases the whole path of travel to it — has to be brought up to the accessibility requirements in the current Ontario Building Code, not the one in effect when the building was built. The most common triggers are:

  1. A major or extensive renovation — particularly one touching entrances, washrooms, or a path of travel.
  2. A change of use or occupancy classification for the space.
  3. A new building permit issued for renovation or addition work.
  4. New construction or redevelopment of the space.
  5. Any alteration that would otherwise reduce existing accessibility — this one is never permitted on its own, trigger or not.

Where this gets genuinely ambiguous: whether a renovation in one part of a building triggers accessibility upgrades elsewhere in that same building is a real, fact-specific question — reviews of the Building Code's accessibility provisions have flagged this as an area with legitimate interpretive uncertainty. If you're planning a renovation and you're not sure whether it triggers a broader obligation, that's a conversation to have with your municipal building department before permits are pulled, not after.

Self-audit, retrofit, certification: how the process actually works

  1. Audit. A site walkthrough against the current Design of Public Spaces Standard and Ontario Building Code accessibility provisions, producing a documented list of barriers.
  2. Prioritize. Barriers get ranked by safety/legal exposure and ease of remediation — not every finding needs to happen at once.
  3. Retrofit. The physical work is specified, the right products sourced, and the installation completed by our team.
  4. Certify. A post-installation inspection confirms the completed work meets the standard that applied at the time of installation, documented in a signed completion record — proof of due diligence if the work is ever questioned later.
